Refund & Cancellation Policy

Scope

This policy applies to all payments made to SSS Competence, Skills & Wellbeing CIC (Company No. 16718061) for access to the SSS Competency Passport (SSSCP), whether as an individual membership or a company licence. 

General Position

 

  • All payments are non-refundable, except in the limited circumstances described in this policy or where required by law.
  • We do not accept liability for downtime or interruptions caused by factors outside our reasonable control, including but not limited to cyber-attacks, internet outages, data-centre failures, or natural disasters. 
  • We are not responsible for issues arising from a customer’s own IT systems, networks, or devices.

Eligibility for Refunds

 A refund will only be considered if all of the following conditions are met:

  1. The SSSCP system is completely and continuously inaccessible due to a proven fault in our software (not third-party infrastructure). 
  2. You have notified us in writing with full details of the issue. 
  3. We fail to restore access within 30 consecutive days of receiving that written notice. 

If these conditions are not all satisfied, no refund or credit will be due.

Exclusions

Refunds will not be issued for:

  • Temporary outages or scheduled maintenance. 
  • Reduced functionality or partial service interruptions. 
  • Downtime caused by third-party hosting or service providers. 
  • Events outside our reasonable control (including cyber-attacks, strikes, or government action), provided we take reasonable steps to restore service. 
  • Failure to use the system, staff turnover, or change of business needs.

Remedy

 

  • Where eligibility is established, we may provide either:
    • A refund limited to the unused portion of the membership or licence period, or
    • A pro-rata credit or extension to the access period. 
  • Refunds will only be made to the original payment method and only to the contracting legal entity or individual.

Consumer Rights

 

  • Individual Memberships (£50): By proceeding with payment, you expressly request and consent to immediate onboarding. In line with the Consumer Contracts Regulations 2013, you acknowledge that your 14-day cancellation right ends once onboarding has begun. 
  • Company Licences (£8,500 + passports): These are business-to-business transactions and are excluded from statutory consumer cancellation rights.

Data Ownership & Processing

All information entered into the SSS Competency Passport (SSSCP) remains the property of the individual or company that provided it. 

SSS Competence, Skills & Wellbeing CIC acts as a data controller for membership and payment information, and as a joint controller with SSSCP for competency and onboarding records. 

Data is collected and processed solely for the purposes of: 

  • Providing access to the SSSCP platform, 
  • Meeting legal and regulatory obligations, and 
  • Ensuring system security and compliance. 
  • We do not sell, trade, or monetise personal or company data. 
  • Data is stored securely and processed in line with the UK GDPR and the Data Protection Act 2018. 
  • Individuals and companies have full rights to access, correct, or request deletion of their data, subject to legal and regulatory retention requirements.
